A continuation of a public hearing will consider a zoning change application for The Habitat, a restaurant and live music venue on Leon Avenue.
The public hearing began last fall but was held over until City of Kelowna staff could confirm whether a restrictive covenant could be placed on the property title preventing it from being turned into a nightclub.
Council heard from Shelley Gambacourt, director of land use management, who told them some of the application information had changed since the original public hearing began Nov. 17.
The B.C. Land Titles Office has advised staff that a restrictive covenant on the property title would not be feasible, Gambacourt told council. As well, the applicants, Quinn and Kat Best, had reduced the capacity of their request from 300 to 225, proposed new alcohol service hours which end at 12:30 a.m. and abandoned their quest for a minors endorsement.
This quelled concerns from Kelowna RCMP about adding to the so-called bar flush and satisfied staff concerns about enforcing the minors endorsement in the primarily adult-oriented nightclub area of downtown.
Despite the changes, staff do not support the proposed zoning change from C7 to C7LP. The public hearing is scheduled for 6 p.m., March 9.
